Terms of service

These terms apply when you use this website or buy from Buenos Bites. "We", "us" and "our" mean BUENOS BITES LIMITED, NZBN 9429054026216. By placing an order you agree to these terms, our refund policy, our shipping policy and our privacy policy.

Your consumer rights

If you buy as a consumer in New Zealand, you have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Nothing in these terms limits those rights. If you buy for business purposes, the Consumer Guarantees Act does not apply, as permitted by section 43 of that Act.

Our products

We make our food in small batches, so size, shape and appearance can vary slightly from the photos. Ingredients, allergen information, storage instructions and best-before or use-by guidance are on each product page and label. If you have an allergy or dietary requirement, please read these carefully and contact us if you have questions before ordering.

Prices and payment

Prices are in New Zealand dollars. Shipping costs are added at checkout. We may change prices at any time, but changes don't affect orders we've already accepted.

Payments are processed securely through Shopify. We never see or store your full card details.

If a product is listed at a clearly wrong price because of an error, we'll contact you before sending it. You can then pay the correct price or cancel for a full refund.

Orders

When you place an order, you'll get an email confirming we've received it. Our contract with you starts when we accept your order, which happens when we email you to say it is out for delivery.

We may decline or cancel an order if a product is unavailable, if we can't deliver to your address, or if we suspect fraud. If we cancel, we'll refund you in full.

Delivery

We deliver ourselves within the Auckland area. Delivery areas, days and times are set out in our shipping policy. Delivery times are estimates, but we're responsible for your order until it is delivered to the address you gave us.

Liability

We're responsible for loss or damage that is a reasonably foreseeable result of us breaching these terms or failing to use reasonable care. Where the law allows, we're not liable for indirect or consequential loss, or for loss caused by events beyond our reasonable control (for example, extreme weather or road closures). Where you buy for business purposes, and the law allows, our total liability is limited to the price you paid for the affected order.

Use of this website

Content on this website, including text, photos, logos and recipes, belongs to us or our licensors. You may not copy or reuse it for commercial purposes without our permission. You must not use the website for anything unlawful or attempt to interfere with how it works.

If you post a review or other content, you confirm it's your honest opinion. You also give us permission to display it on our website and social media. We may remove content that is misleading, offensive or unlawful.

Changes to these terms

We may update these terms from time to time. The version on this page at the time you place an order is the one that applies to that order.

Law and disputes

These terms are governed by New Zealand law. If you have a concern, please contact us first, and we'll try to sort it out quickly and fairly. If we can't, you can take your claim to the Disputes Tribunal or the New Zealand courts.
